Court Cites Consensual Relationship and Lack of Injuries as Key Factors in Bail Decision


In a notable decision, the Allahabad High Court has granted bail to Satish Kumar Yadav, also known as Prabhas Yadav, who was accused under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and the Dowry Prohibition Act, 1961. The judgment, delivered by Justice Pramod Kumar Srivastava, emphasized the consensual nature of the relationship between the appellant and the prosecutrix and noted the absence of external or internal injuries on the prosecutrix as per the medical report.


The case, originating from Lucknow under Case Crime No. 213/2025, involved allegations of sexual assault and dowry demands. Initially, eight individuals were named as accused in the FIR, but charges were eventually pressed solely against Satish Kumar Yadav. The appellant has been in jail since June 16, 2025.


During the hearing, the court observed that the prosecutrix had admitted to a consensual physical relationship with the appellant. The medical examination further corroborated the lack of coercion, showing no signs of injuries. These findings played a pivotal role in the court’s decision to overturn the Special Judge's previous denial of bail.


The defense argued that the appellant had been falsely implicated and assured the court of his commitment to complying with bail conditions, including cooperating with the prosecution and not intimidating witnesses. The prosecution, on the other hand, maintained that the appellant had a criminal history and was actively involved in the alleged crimes.


Justice Srivastava, after assessing the evidence and circumstances, concluded that the lower court had failed to appreciate the material on record and granted bail to Yadav, imposing several stringent conditions to ensure compliance. The appellant must not tamper with evidence, intimidate witnesses, or commit any further offenses. He is required to attend all court dates, especially when witnesses are present, and must be present for the recording of statements under Section 313 of the Cr.PC.


The judgment underscores the importance of ensuring that bail conditions are not abused and clarifies that observations made during the bail proceedings should not influence the trial's merits. This ruling may have broader implications for how consensual relationships are viewed in cases involving allegations under the SC/ST and Dowry Prohibition Acts.
