Allahabad High Court Interprets "Government Office" in Eligibility Criteria for Assistant Registrar Exam

Court Dismisses Several Petitions, Orders Reconsideration in Select Cases for Assistant Registrar Eligibility

In a significant ruling, the Allahabad High Court has provided clarity on the interpretation of "Government Office" in relation to eligibility criteria for the Uttar Pradesh University (Centralised) Service Assistant Registrar Examination-2024. The decision was delivered in the case of Geeta Chandra v. State of U.P., where numerous writ petitions were heard together by Justice Saurabh Shyam Shamshery.

The Court concluded that employment in entities like state instrumentalities, public sector undertakings, and independent entities does not qualify as employment in a "Government Office" under the direct control of the State or Union Government. This strict interpretation led to the dismissal of several petitions where candidates claimed eligibility based on their experience in such organizations.

For instance, the petition of Geeta Chandra, who worked as a 'Senior Associate' in Indian Air Lines Ltd., was dismissed on the grounds that her employment did not fall under the definition of a "Government Office." Similarly, other petitions from candidates working in government undertakings such as Uttar Pradesh Rajya Vidyut Utpadan Nigam Limited and Uttar Pradesh Power Corporation Limited were also dismissed.

However, the Court ordered reconsideration in cases where candidates worked in entities like the Airports Authority of India, which may qualify as a "Government Office" under the Central Government's control. The Court also called for clarification from the State regarding employment in deemed universities and private universities, indicating that a fresh order should be passed after assessing these entities' status.

This ruling has implications for candidates seeking positions under the Centralised Services, emphasizing the need for employment under direct government control to meet eligibility requirements. The Court's decision underscores the judiciary's role in interpreting statutory language and ensuring adherence to established rules.

Bottom Line:

Interpretation of "Government Office" for determining eligibility under Uttar Pradesh University (Centralised) Service Assistant Registrar Examination-2024.

Statutory provision(s): Uttar Pradesh State University (Centralised) Service Rules, 1975, Rule 13
