Court Finds Disciplinary Proceedings Against University Staff Officer Tainted with Mala Fides and Vindictive Intent


In a landmark judgment, the Allahabad High Court has quashed the termination order of Smt. Meena Singh, Staff Officer to the Vice Chancellor at Gautam Buddha University, Greater Noida, Gautam Budh Nagar. The petitioner had been embroiled in disciplinary proceedings over allegations of submitting a fake Ph.D. degree and using the salutation 'Dr.' before her name. Justice Manju Rani Chauhan presided over the case, delivering a judgment that underscores the principles of fair play and the absence of bias in administrative actions.


Smt. Meena Singh was initially suspended following a complaint allegedly made by Vishnu Pratap Singh, which was later disowned by the supposed complainant. The High Court found that the disciplinary proceedings were initiated with a vindictive approach following a complaint lodged by the petitioner against the officiating Registrar, Sri. S.N. Tiwari, alleging misbehavior and sexual harassment.


The court noted that the petitioner had never submitted a fake Ph.D. degree to the university and emphasized that the proceedings were influenced by personal bias, reflecting a pre-determined and vindictive approach. The judgment highlighted significant procedural lapses and the absence of material evidence to substantiate the charges against the petitioner. It was observed that the initiation of proceedings was an abuse of process, motivated by extraneous reasons, and aimed at victimizing the petitioner.


Justice Chauhan directed the University to reinstate Smt. Meena Singh as Staff Officer to the Vice Chancellor, emphasizing the absence of any legal or factual basis for the termination. The court condemned the actions of the university authorities, particularly the Registrar, for acting with bias and malice, resulting in unjust disciplinary proceedings.


This judgment reinforces the importance of unbiased and fair administrative conduct in disciplinary matters, setting a precedent for future cases involving allegations of misconduct without substantial evidence.
