Court Affirms Legally Wedded Wife's Right to Maintenance Despite Ex Parte Order
In a significant ruling, the Allahabad High Court has upheld an order granting interim maintenance to a woman under the Protection of Women from Domestic Violence Act, 2005. The decision was rendered by Justice Garima Prashad, confirming the lower court's directive for Dinesh Kumar Sharma, the revisionist, to pay Rs. 4,000 per month to his wife.
The case originated when the wife, alleging domestic violence, filed for interim maintenance under Section 23 of the Domestic Violence Act. Despite being duly served, Sharma failed to appear in court, resulting in an ex parte order. The trial court found the wife's claims unrebutted and granted her interim maintenance, citing her lack of independent income.
Sharma challenged the order, arguing that the wife was educated and capable of earning. However, the High Court emphasized that education alone does not negate the husband's obligation to provide for his wife in the absence of evidence of her gainful employment.
The court further rejected Sharma's claims of financial hardship, noting his ability to meet credit card payments and children's expenses as indicative of his financial capacity. Additionally, the court clarified that substantive defenses regarding the merits of the case cannot be raised in a challenge to an ex parte order.
Reaffirming the principle that a husband must not leave his wife without means of sustenance, the High Court dismissed the revision, allowing the interim maintenance order to stand. The court urged Sharma to participate in the ongoing trial court proceedings to resolve the matter comprehensively.
