Madhya Pradesh High Court Finds No Prima Facie Evidence Against Deepak Jain Under SC/ST Act; Call Records Contradict Prosecution's Claim
In a recent decision, the Madhya Pradesh High Court, under the judgment of Justice Ramkumar Choubey, has granted anticipatory bail to Deepak Jain, the elected President of the District Bar Association, Narmadapuram. Jain was accused of instigating an assault on the complainant, Rakesh Kumar Sharma, who is also an elected Treasurer of the same association. The case, registered under Crime No. 386/2026, involved charges under the Bharatiya Nagarik Suraksha Sanhita, 2023, and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The allegations stemmed from a heated dispute during a meeting of the Bar Association's office bearers on April 17, 2026, which reportedly escalated into a WhatsApp altercation between Jain's son and the complainant. The prosecution alleged that Jain made an abusive phone call to Sharma, warning him that his sons would assault him. This was followed by an alleged assault by Jain's sons at Sharma's office later that night.
However, the High Court found significant inconsistencies in the prosecution's narrative. Crucially, the Call Detail Records (CDR) contradicted the claim that Jain had called the complainant. Instead, records showed that it was Sharma who initiated calls to Jain on the night in question. Additionally, Jain was not present at the scene of the alleged assault, and no incriminating evidence was found linking him directly to the incident.
Justice Choubey emphasized the principle that anticipatory bail applications should not delve deeply into case merits but require a prima facie evaluation of the allegations. The court noted the absence of any specific overt act attributed to Jain that would justify the denial of bail. Furthermore, the court acknowledged that no prima facie case was established under the SC/ST Act against Jain, as he had neither a direct nor an indirect altercation with the complainant or any other person involved.
Despite an earlier attempt by the court to mediate an amicable settlement between the parties, the mediation efforts were unsuccessful. In light of these findings, the court granted anticipatory bail to Jain, directing his release upon arrest on a personal bond of Rs. 50,000, with one solvent surety of the like amount. Jain is also required to adhere to conditions set forth under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
This decision underscores the importance of examining evidence and maintaining the rights of individuals against whom charges are levied, especially in cases where statutory bars under special acts like the SC/ST Act are invoked.
