Bombay High Court Orders Investigation into Alleged Forgery of Court Orders

Registrar General Directed to Collaborate with Police and Cyber Cell in Uncovering Fabricated Orders

In a significant development, the Bombay High Court has ordered a detailed investigation into allegations of forgery and fabrication of court orders. The case, titled Shylender Jindal v. Rekha Parmanand Jindal, has brought to light serious claims involving fabricated court documents. The inquiry was mandated by Justice Arif S. Doctor, who is presiding over the matter.

The controversy arose when Shylender Jindal, the Applicant and Defendant No. 1 in the suit, filed an interim application seeking the recall of specific court orders dated January 24, 2025, and February 7, 2025. Jindal alleged that these orders were fabricated and sent to him by an Additional Respondent who was appointed as his advocate. The alleged fabricated orders were presented as Exhibits 'E' and 'F' in the court documents, while the genuine orders are annexed as Exhibits 'A' and 'G'.

The Additional Respondent, appearing in person, has denied these allegations and counter-alleged that the forgery was orchestrated by the Applicant himself. Mr. Ryan D'souza, counsel for the Applicant, has expressed openness to any inquiry into the allegations, indicating confidence in his client’s innocence.

Recognizing the seriousness of the situation, Justice Doctor emphasized the need to ascertain the origin and intent behind the fabricated orders. Consequently, the Registrar General of the Bombay High Court has been instructed to file a formal complaint with the police and the Cyber Cell. An inquiry is to be conducted to determine how the documents in question came into existence. The court has requested that a detailed report be submitted within four weeks.

Justice Doctor clarified that the merits of the allegations have not been considered at this stage and that the interim application will be revisited after the completion of the inquiry. The investigation is expected to shed light on the circumstances surrounding this case of alleged legal document forgery, which holds significant implications for the involved parties.

Bottom line:-

Allegation of forgery and fabrication of court orders - Court orders investigation by Registrar General with police and Cyber Cell to determine the circumstances under which fabricated orders came into existence.
