Court Finds Complainant's Conduct Malafide with Multiple False Allegations of Rape

In a significant ruling, the Bombay High Court has quashed an FIR against Manoj Balasaheb Dhanavade, accused of rape on the false promise of marriage. Justice Ranjitsinha Raja Bhonsale ruled that the allegations were baseless, describing the complainant's actions as a blatant abuse of legal process. The court emphasized the complainant's history of filing similar false allegations against various individuals, including police officers and businesspersons, highlighting her malafide intent.


The case traces back to an FIR filed by the complainant, who alleged that Dhanavade, a tour manager, promised marriage and subsequently raped her during a tour to Malaysia and Singapore. However, Justice Bhonsale noted the complainant's pattern of filing multiple complaints of a similar nature, many of which had resulted in acquittals due to her failure to prosecute.


In a detailed judgment, the court observed that the complainant had a history of instituting proceedings under Section 376 of the Indian Penal Code (IPC) against different individuals, often on identical grounds. The court found her conduct to be an abuse of the process of law, intended to harass and blackmail the accused. The ruling was supported by a comprehensive examination of previous cases filed by the complainant, many of which were either quashed or resulted in acquittals due to lack of evidence or her absence during proceedings.


Justice Bhonsale further directed the Director General of Police, Maharashtra, to ensure that police stations maintain records of the complainant's previous complaints. The police were advised to conduct a preliminary inquiry before registering any new FIR filed by her, ensuring that legal processes are not misused.


This decision underscores the judiciary's commitment to preventing the misuse of legal provisions and ensuring justice is not obstructed by malicious litigations. The ruling also serves as a cautionary tale against the abuse of legal systems for personal vendettas.
