In a landmark decision, the Bombay High Court, presided by Justice Sharmila U. Deshmukh, has granted an injunction against Pruthvi Ishwar Patel, proprietor of Maa Bahucharaji Sales, for using an artwork deemed to be deceptively similar to that of Anil Srichand Kundnani, the proprietor of Bhagyalaxmi Tea Centre. The court found that the defendant's use of the "UTSAHA" label constituted a slavish reproduction of the plaintiff's original artistic work "UMANG", thereby infringing upon the plaintiff's copyright and leading to passing off.
The plaintiff, Anil Srichand Kundnani, had established the "UMANG" label for marketing premium quality packaged tea and coffee since 2009, building significant goodwill and reputation in the market. Despite the defendant's claims of originality, the court determined that the defendant's artwork was a near-identical reproduction of the plaintiff's label, with similar color schemes, design elements, and placement, which could mislead consumers.
Justice Deshmukh emphasized that the plaintiff had successfully demonstrated the originality and prior use of the "UMANG" artwork. The court also noted that the defendant's copyright application for a cropped version of the artwork lacked transparency and did not justify the significant similarities with the plaintiff's design.
The court's decision highlighted the importance of protecting artistic works and trademarks from deceptive reproductions that could harm a business's goodwill. By granting an ad-interim injunction, the court has reinforced the plaintiff's rights under the Copyright Act, 1957, and the Trademarks Act, 1999.
