Calcutta High Court Upholds SBI Circulars on Mandatory Learning for Officer Reimbursements

Officers Must Complete Learning Modules to Qualify for Expense Reimbursements, Rules Calcutta High Court


In a significant judgment, the Calcutta High Court has upheld the State Bank of India (SBI) circulars linking officer reimbursements to the completion of mandatory learning programs. The decision, delivered by Mr. Justice Raja Basu Chowdhury, addresses a petition challenging the SBI circulars dated April 30, 2021, and June 2, 2021, which introduced mandatory learning requirements for officers from Scale I to V.


The All India State Bank Officers Federation, representing the petitioners, argued that the circulars unjustly linked reimbursements of expenses such as conveyance, newspapers, and internet usage to the completion of learning modules, impacting officers' financial packages. The petitioners contended that the condition lacked a rational nexus to the reimbursement policy and constituted a form of double jeopardy by affecting both reimbursements and promotion opportunities.


Justice Chowdhury, however, rejected these arguments, emphasizing that the circulars were neither arbitrary nor unreasonable. He noted that the bank's objective was to ensure skill enhancement among officers to secure its operations against technological frauds and money laundering. The court further held that officers who fail to complete the mandatory learning cannot claim reimbursement as a legal right, as these benefits are discretionary and not part of the formal service rules.


The judgment also addressed concerns of discrimination under Article 14 of the Constitution, affirming that there is a reasonable classification between officers who complete the learning modules and those who do not. The court pointed out that the classification has a direct nexus to the bank's objective of enhancing security and reducing operational risks.


The petitioners' reliance on previous Supreme Court judgments concerning equality and classification was deemed inapplicable, as the court observed that the circumstances and objectives in the SBI case were distinct.


Ultimately, the court dismissed the petition, reinforcing the bank's authority to impose such conditions under Rule 65(A) of the State Bank of India Officers' Service Rules, 1992. This ruling reinforces the importance of continuous learning and skill upgrades in the banking sector to tackle evolving challenges.
