In a significant judgment, the Chhattisgarh High Court has quashed the appointment of a lecturer to the post of Block Education Officer, asserting that administrative posts should be filled by candidates from the relevant administrative cadre. The court's decision comes in response to a writ petition filed by Ravi Kumar Gautam, challenging the appointment of a lecturer from the teaching cadre to an administrative position.


Presided over by Justice Bibhu Datta Guru, the court emphasized the importance of adhering to the Chhattisgarh School Education Services (Educational and Administrative Cadre) Recruitment and Promotion Rules, 2026. The judgment reinforces that administrative roles should be occupied by individuals from the feeder cadre with requisite experience and eligibility.


The case involved the appointment of a lecturer, who was serving as the Incharge Principal of P.M. Shri Swami Atmanand English Medium School, Baloda, as the Block Education Officer in Balod District, Janjgir-Champa. The petitioner, Ravi Kumar Gautam, who was an Assistant Block Education Officer, argued that such an appointment was illegal and violated statutory provisions, particularly Section 27 of the Right of Children to Free and Compulsory Education Act, 2009.


The court observed that the statutory framework maintains a clear distinction between teaching and administrative cadres, a distinction essential for ensuring that administrative posts are filled by suitably experienced individuals within the prescribed cadre. The appointment of a teaching cadre member to an administrative post was deemed contrary to the legislative intent and the statutory scheme.


Justice Guru noted that the petitioner had been discharging his duties as an Assistant Block Education Officer since 2015 and was eligible for the post of Block Education Officer. The court found no documented evidence to support claims of the petitioner's unsatisfactory performance, which was one of the justifications used for the lecturer's appointment.


The judgment underscores that the legislative intent of the Right of Children to Free and Compulsory Education Act, 2009, particularly Section 27, restricts the deployment of teachers for non-educational purposes. The court's decision nullifies the order dated June 10, 2026, that had assigned the Block Education Officer role to the lecturer, thereby upholding the petitioner’s writ.


The verdict reiterates the necessity for adherence to recruitment and promotion rules within the education department, ensuring that administrative positions are filled through proper channels and by individuals with the requisite qualifications and experience.
