Thakur, a socio-political worker, was detained during the Emergency from August 31, 1975, to January 10, 1977. He argued that his detention was solely due to his involvement in socio-political movements and sought financial assistance under the 2008 Rules. However, the Committee found that Thakur had multiple criminal cases registered against him, rendering him ineligible for the benefits.
The court emphasized that Thakur failed to challenge the Committee's decision directly, focusing instead on the administrative communication from the Collector. The bench reiterated that judicial review does not allow the substitution of the court's opinion for that of the statutory authority unless there is a clear violation of law or procedure.
Furthermore, the court addressed Thakur's contention that the expression "Rajnaitik ya Samajik Karno Se Niruddha Vyakti" in the 2008 Rules was ultra vires to the MISA Act. The bench stated that such a challenge was not pertinent to the present appeal, which primarily concerned the denial of Samman Nidhi based on the appellant's criminal record.
