Inquiry initiated into potential abuse of dominance and vertical restraints in the poultry industry, affecting market competition and consumer choice.
The Competition Commission of India (CCI) has initiated a formal investigation into Venkateshwara Hatcheries Group (VH Group) for alleged anti-competitive practices in the Indian poultry industry. The decision follows a detailed complaint by People For Animals (PFA), a reputed animal welfare organization, which highlighted alleged abuses of dominance and vertical restraints that could adversely affect market competition and consumer choice.
The CCI's inquiry focuses on the VH Group's alleged contravention of Section 3(4) of the Competition Act, 2002, which deals with anti-competitive agreements, and Section 4, which pertains to abuse of dominant position. The complaint accuses VH Group of imposing restrictive clauses in their Broiler Breeder Agreement (BBA) and Layer Breeder Agreement (LBA), which purportedly prevent breeders from selling products outside designated territories or dealing with alternative breeds.
The VH Group, recognized as Asia's largest fully integrated poultry group, is alleged to have significant control over the Indian poultry sector, including substantial influence within key organizations such as the National Egg Coordination Committee (NECC) and the Bharat Egg Producers Association (BEPA).
The CCI's order calls for the Director General (DG) to conduct a thorough investigation within 90 days. The investigation will examine whether the VH Group's practices have resulted in appreciable adverse effects on competition (AAEC) in the relevant markets, which include the production and supply of layer hen and broiler chicken breeds across India. The DG is also tasked with investigating the roles of individuals responsible for the alleged contraventions under Section 48 of the Act.
The CCI's decision to investigate comes amid concerns about the VH Group's vertical integration model, which, while common in the poultry industry, may be leading to anti-competitive outcomes. This includes potential market foreclosure, reduced consumer choice, and inflated prices for poultry products, which could be adversely affecting consumers and smaller market players.
The VH Group has denied the allegations, asserting that their business practices align with industry standards and contribute to operational efficiency and consumer benefits. However, the CCI has noted the need for an investigation to ascertain the impact of these practices on market competition.
The investigation will also consider whether similar vertical agreements by other significant players in the poultry industry may be contributing to AAEC. The CCI has emphasized that the investigation's findings will determine if any corrective actions or penalties are warranted under Section 27 of the Competition Act.
