Court Orders Blocking of Website Infringing Trademarks and Engaging in Phishing
In a significant ruling, the Delhi High Court has granted an ex parte ad interim injunction in favor of Shubham Goldiee Masale Pvt. Ltd., restraining an unidentified entity, referred to as "defendant no.1," from the unauthorized use of the company’s trademarks and related artistic works. The order was issued by Justice Saurabh Banerjee on June 1, 2026, amid concerns of phishing and cyber fraud perpetrated via a fraudulent website.
The plaintiff, Shubham Goldiee Masale Pvt. Ltd., approached the court seeking relief for the infringement of its well-known trademarks, "Goldiee," "One One," and "Goldiee One One Noodles," along with copyrights and artistic works. The defendant was found operating a fraudulent website under the domain https://goldeeejkskksnewmasala.live, which mimicked the plaintiff's branding to deceive the public into participating in unauthorized online schemes.
Justice Banerjee, acknowledging the prima facie evidence of deception and phishing, ruled that the defendant was likely engaging in cyber fraud to exploit the plaintiff's goodwill. The court found the balance of convenience and irreparable harm in favor of Shubham Goldiee Masale, warranting immediate judicial intervention.
The High Court directed the domain name registrar, Dynadot Inc., and the web hosting service provider, Cloudflare Inc., to block the fraudulent website within 72 hours. Furthermore, these entities were ordered to preserve all electronic records related to the impugned domain to aid in future legal proceedings.
The Department of Telecommunications and the Ministry of Electronics and Information Technology were also tasked with ensuring compliance with the court’s orders by facilitating communication with the involved internet service providers.
The decision underscores the judiciary's proactive approach in safeguarding intellectual property rights and protecting consumers from online fraud. The case is scheduled for further proceedings on August 5, 2026, before the Joint Registrar, with a subsequent hearing on September 22, 2026, before the Roster Bench.
