Delhi High Court Orders Surrender of Rajpal Yadav for Sentence Over Breach of Settlement

The actor was directed to surrender following repeated breaches of court assurances and non-compliance with financial obligations.


In a significant legal development, the Delhi High Court has ordered actor Rajpal Naurang Yadav to surrender before the Jail Superintendent by February 4, 2026, following repeated breaches of settlement agreements and failure to comply with court-ordered payments in a case involving M/s. Murli Projects Pvt. Ltd. The court, presided over by Dr. Swarana Kanta Sharma, J., expressed its discontent with the continuous defaults by the petitioners, despite multiple opportunities and leniency shown by the court.


The case, which was first listed on June 28, 2024, saw the petitioners failing to honor their commitments regarding the payment of settlement amounts on numerous occasions. Initially, the court had suspended the sentence awarded to the petitioners, hoping for an amicable settlement. However, despite assurances, the required payments were not made.


The petitioners were supposed to deposit two demand drafts totalling Rs. 75 lakhs and still owed Rs. 9 crores to the respondents. Despite extensions and assurances of payment in installments, significant portions of the settlement amounts remained unpaid. The court noted that the petitioners repeatedly failed to comply with the orders, citing various reasons, including typographical errors in demand drafts.


The court's patience wore thin as it observed that the petitioners had not only failed to meet the payment deadlines but also provided unsatisfactory explanations for their defaults. Given the circumstances, the court decided to withdraw its indulgence and ordered the release of any amounts already deposited to the respondent while directing Rajpal Yadav to surrender to serve his sentence.


Despite the stringent order, a limited indulgence was granted to allow Yadav to complete certain professional commitments in Mumbai. The court has scheduled a compliance check on February 5, 2026, to ensure adherence to its directive.

Repeated breach of undertakings given before the Court and failure to comply with payment obligations can lead to withdrawal of judicial indulgence, including suspension of sentence.
