Delhi tribunal awards Rs 23 lakh to man suffered permanent disability in road accident

New Delhi, Jun 28 A Delhi Motor Accident Claims Tribunal has awarded over Rs 23 lakh to a man who suffered grievous injuries and permanent disability in a 2020 road accident.


Presiding Officer Sudeep Raj Saini was hearing a claim petition filed by Parmanand Rai, who suffered permanent disability after being hit by a car in 2020.


In an order dated June 9, the tribunal said, "... the accident in question was caused due to rash and negligent driving of offending car, being driven by respondent no. 1, Devender."


According to the tribunal, Rai was crossing the road in Najafgarh on the night of February 29, 2020, when a speeding car hit him.


The tribunal held that the accident occurred due to the rash and negligent driving of the offending car, relying on the Detailed Accident Report, the petitioner's testimony, medical records and the charge sheet.


According to the court proceedings, Rai was working as a vegetable seller at the time of the accident.


The tribunal assessed Rai's functional disability and loss of earning capacity at 30 per cent and awarded Rs 23.16 lakh in compensation to him under various heads.


The tribunal noted that the car was insured at the time of accident and directed the insurance company to deposit the compensation amount to the victim.
