In a significant ruling, the Supreme Court of India quashed the FIR registered against Gabbar Singh alias Devendra Pratap Singh alias Rajesh Singh under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986. The bench, comprising Justices Sanjay Kumar and K. Vinod Chandran, found that the Gang Chart, a crucial document for such FIRs, failed to comply with necessary procedural requirements as prescribed by the Act and the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Rules, 2021.


The FIR, initially registered at Police Station Kotwali Nagar, District Bahraich, was based on allegations of gang activities including land grabbing, extortion, and other criminal offenses. However, the Court observed that the Gang Chart, which was supposed to be a foundational document for the FIR, lacked mandatory recommendations and signatures from competent authorities, including the Nodal Officer, Additional Superintendent of Police, Superintendent of Police, and District Magistrate. This non-compliance rendered the FIR unsustainable.


The Supreme Court emphasized the importance of adhering to statutory procedures, particularly when individual liberty is at stake. The Court clarified that while the FIR was quashed due to procedural irregularities, this did not preclude authorities from taking lawful action against crimes mentioned in the Gang Chart, provided they adhere to prescribed procedures.


The judgment highlights the judiciary's role in ensuring procedural integrity in criminal proceedings and upholding the principles of justice and individual rights.
