Gujarat High Court Steps in to Safeguard Meritorious Student’s Medical Career

The case arose when Patel Stuti Vaishalkumar, a meritorious candidate, failed to submit a provisional admission order due to a misunderstanding, leading to her seat being marked as vacant in the admission process. Despite having paid the necessary fees and begun her studies, the procedural lapse threatened her admission.
The court, presided by Justice Nirzar S. Desai, recognized the potential injustice of depriving a capable student of her rightful place in the MBBS course over a minor procedural error. In its judgment, the court emphasized that such lapses should not result in the wastage of talent. The decision reflects a compassionate approach, allowing the student's admission to be regularized.
As a condition of this relief, the court imposed a token penalty of Rs. 5,000 on the petitioner, which is to be paid to the Gujarat State Legal Services Authority. Furthermore, the student agreed to an additional commitment of serving in rural areas for six months post her graduation, demonstrating accountability and willingness to contribute to underserved communities.
