In a landmark judgment dated February 5, 2026, the Jammu and Kashmir High Court upheld the decision of the Jammu and Kashmir Public Service Commission (JKPSC) to select a candidate for the position of Assistant Professor under the Economically Weaker Sections (EWS) category. The court ruled that a candidate's certificate should not be invalidated solely due to being in an incorrect format if it meets the eligibility requirements and is later clarified by the issuing authority.


The case involved petitioner Priyanka Rakwal, who challenged the decision of the Central Administrative Tribunal, Jammu Bench, which had dismissed her plea against the selection process. The dispute centered around the EWS certificate of respondent No. 4, who was initially excluded from the selection list despite having higher merit, due to the certificate being in the wrong format.


The High Court, presided over by Justices Sanjeev Kumar and Sanjay Parihar, found that the EWS certificate dated May 31, 2023, although not in the prescribed format, met all substantive eligibility criteria. The certificate was later clarified by the Tehsildar, Kathua, affirming its validity under the J&K Reservation Rules, 2005.


The court emphasized that the essence of the law is to ensure eligibility, not to penalize candidates for procedural errors by the issuing authority. It held that a candidate should not be denied selection if they fulfill all eligibility requirements, even if their certificate was issued on an incorrect format, provided there is a subsequent clarification.


This judgment underscores the principle that substance should take precedence over form, especially in matters concerning social justice and reservation policies. The court's decision is expected to have significant implications for similar cases where technical errors in documentation might otherwise deny deserving candidates their rightful opportunities.
