Jharkhand High Court Grants Anticipatory Bail to Abhay Kumar Mishra Despite Chargesheet Submission

Chargesheet filing not a barrier for anticipatory bail, emphasizes court; petitioner directed to surrender within three weeks


In a significant decision, the Jharkhand High Court, presided over by Justice Sanjay Kumar Dwivedi, has granted anticipatory bail to Abhay Kumar Mishra, who was apprehending arrest in connection with a case involving allegations of fraud and corruption. The case, registered under Jagarnathpur P.S. Case No. 314 of 2017, has been pending before the Judicial Magistrate, 1st Class-IV, Ranchi. The chargesheet, filed on December 31, 2023, includes charges under various sections of the Indian Penal Code, such as Sections 406, 420, 467, 468, 379, and 120(B)/34.


The court emphasized that the filing of a chargesheet does not inherently bar the granting of anticipatory bail. Justice Dwivedi referenced landmark judgments, including the Gurbaksh Singh and Ravindra Saxena cases, underscoring that anticipatory bail applications should be evaluated on their merits and the specific circumstances of each case.


During the proceedings, Mishra's counsel argued that the allegations were politically motivated and stemmed from his election as Secretary of a school. The counsel highlighted the petitioner's cooperation during the investigation and pointed out that similar allegations in a different case had previously resulted in anticipatory bail being granted.


The Additional Public Prosecutor for the state contended that, given the submission of the chargesheet, Mishra should face trial. Meanwhile, the informant's counsel, Mr. Mahesh Tewari, opposed the bail plea, citing financial discrepancies and alleged misuse of school funds.


After reviewing the case details and submissions, the court ruled in favor of anticipatory bail, directing Mishra to surrender before the trial court within three weeks and to furnish bail bonds of Rs. 25,000 with two sureties. The court also imposed conditions for Mishra to cooperate during the trial.


This ruling highlights the court's approach to safeguarding personal liberty while ensuring that legal proceedings are not obstructed by technicalities such as the mere filing of a chargesheet.


Bottom line:-

Anticipatory bail can be granted even after the filing of the chargesheet. Filing of a challan or chargesheet does not, by itself, bar the grant of anticipatory bail. Each application must be considered on its merits and in light of the facts and circumstances of the case.
