Suo Motu Proceedings Aim to Address Delays and Ensure Compliance with Supreme Court Directions
In a landmark move, the Kerala High Court, under the leadership of Chief Justice Nitin Jamdar and Justice S. Manu, has initiated suo motu proceedings to monitor and expedite pending criminal cases against sitting and former Members of Parliament (MPs) and Members of Legislative Assembly (MLAs) in Kerala. The court's action is in response to directives issued by the Supreme Court in *Public Interest Foundation v. Union of India*, emphasizing the need for timely trials and judicial accountability.
The suo motu case, labeled OP(CRL.) No. 448 of 2021, was brought forth to ensure compliance with the Supreme Court's practice directions, which mandate the establishment of Special Courts in each district for trials involving MPs/MLAs and call for expedited proceedings. The High Court's initiative aims to address procedural delays, such as non-service of summons and non-appearance of accused, which have been major bottlenecks in the justice system.
The court's detailed analysis revealed a staggering number of cases pending at various stages. Specifically, 313 cases are unresolved, with 294 awaiting procedural compliance. Of these, 18 are stalled at the charge-framing stage, while another 154 are delayed due to the accused's non-appearance, and 141 face non-service of process issues.
Justice Jamdar highlighted the importance of judicial accountability and the need for timely justice, emphasizing that many cases have languished for years—some for over a decade—due to procedural inefficiencies. The court directed the Home Secretary of Kerala to ensure service of process is completed within three months, assigning responsibility to district-level Deputy Superintendents of Police to oversee compliance.
The Director General of Prosecution assured the court of the state's commitment to resolve these procedural issues swiftly, promising necessary steps to ensure trials proceed without further delay.
The proceedings underscore the High Court's dedication to upholding the rule of law and ensuring that justice is delivered efficiently. The next hearing is scheduled for May 20, 2025, to assess compliance and progress.
