Court Directs Reissuance of SOP and Completion of e-Prison Modules within Strict Timelines
In a significant move towards reforming prison management and enhancing prisoner rights, the Kerala High Court, through a suo motu writ petition, has issued directions to the State Government for the swift implementation of the "Support to Poor Prisoners Scheme." The Court has mandated the reissuance of a comprehensive Standard Operating Procedure (SOP) and completion of e-Prison modules within stringent timelines to ensure effective judicial oversight and safeguard prisoners' rights.
Presided over by Justices Raja Vijayaraghavan V and K.V. Jayakumar, the Court emphasized the importance of implementing a revised SOP prepared by the Kerala State Legal Services Authority (KeLSA), which was found to be more progressive and beneficial compared to the Union guidelines. The revised SOP, issued on February 4, 2026, incorporates advanced provisions favorable to prisoners and calls for the revocation of the previous SOP within a month.
The judgment also highlighted the necessity of operationalizing the e-Prison portal, directing the National Informatics Centre (NIC) and other stakeholders to ensure the completion of all modules within two weeks from the date of the order. The Court underlined the importance of coordinated efforts among various departments, including the NIC, Prison Department, and KeLSA, for effective module completion and training of stakeholders.
The Kerala High Court underscored the significance of training programs for data entry operators and responsible officers from all prisons in the state to ensure the seamless functioning of the e-Prison system. Detailed compliance reports and affidavits of completion are required from the involved entities, reinforcing accountability and effective implementation.
The Court's directive is a response to the Apex Court's orders, which identified the plight of many accused languishing in prisons despite being granted bail due to their inability to meet bail conditions. The Kerala High Court's proactive stance aims to rectify systemic deficiencies, enhance data management, and uphold the rights of prisoners across the state.
