High Court confirms the conviction of two accused under Prevention of Corruption Act and IPC; sanctions hefty fines and imprisonment.
Thiruvananthapuram: The Kerala High Court, presided over by Justice A. Badharudeen, has upheld the convictions of T.O. Abraham and others in a high-profile corruption case involving misuse of official positions by public servants to grant undue pecuniary benefits to a contractor. The court confirmed the sentences handed down by the Special Judge, Thiruvananthapuram, in Criminal Appeals No. 106 of 2011 and No. 9 of 2011.
The case involved allegations against the first accused, a retired Superintending Engineer, and the second accused, a contractor, who were charged with conspiring to grant excessive payments for construction work related to the Kulasekharapuram Irrigation Project. The court found that the accused violated contractual clauses to sanction exorbitant amounts just before the retirement of the first accused, leading to substantial financial losses to the government.
The High Court meticulously reviewed the evidence presented, confirming that the accused violated clauses 31 and 32 of the Local Competitive Bidding (LCB) specifications. These violations resulted in the unlawful gain of Rs. 34,78,415 for the contractor, which was a significant loss to the public exchequer.
Despite arguments from the defense that the work required extra costs due to unforeseen conditions like slushy soil, the court found these claims unsubstantiated. The court emphasized that the accused misused their positions to negotiate unwarranted rates and executed supplemental agreements without proper authorization.
The court also addressed the contention regarding the need for prosecution sanction under Section 19 of the Prevention of Corruption Act, clarifying that no sanction was required as the accused was retired at the time of cognizance.
In its judgment, the court confirmed the rigorous imprisonment and a fine of Rs. 17 lakh each imposed on the accused. However, the sentence against the deceased first accused was abated, with the court directing the realization of the fine from his legal heirs.
This judgment serves as a stern reminder of the judiciary's stance against corruption and misuse of public office, reinforcing the accountability of public servants in adhering to legal and ethical standards.
