Manjumol, filed for compensation, dissatisfied with the Motor Accidents Claims Tribunal's award of Rs. 4,60,800, which she argued was insufficient.
The Tribunal had previously denied dependency compensation, citing the widow's employment and subsequent remarriage as grounds for ineligibility. However, the High Court found this reasoning flawed, asserting that such factors should not influence the assessment of compensation for dependency loss. The court underscored that discouraging remarriage by denying compensation contradicts societal progress and legal principles.
Drawing on precedents such as the Supreme Court's decisions in Sarla Verma and Pranay Sethi, the High Court recalculated the loss of dependency, including future prospects in the deceased's income, and awarded an enhanced compensation of Rs. 15,40,992 under this head. Additionally, adjustments were made for loss of estate, funeral expenses, and loss of consortium, culminating in a total compensation of Rs. 16,25,542, inclusive of interest from the petition date.
