Review Petition Dismissed; Delay and Laches Not Grounds to Deny Statutory Entitlements


In a significant ruling, the Madhya Pradesh High Court has dismissed a review petition filed by the State of Madhya Pradesh, reaffirming the right of a retired employee, Suresh Chandra Ojha, to receive Kramonnati/time-bound pay scale benefits with retrospective effect. The judgment, delivered by Justice Jai Kumar Pillai, emphasized that delay and laches cannot be used to deny rightful benefits when the delay is due to the employer's fault.


The case originated from a writ petition filed by Ojha in 2025, demanding the implementation of the Kramonnati benefits allegedly due since 2003. The State opposed the petition, citing the delay and financial implications. However, the court had initially ruled in favor of Ojha in February 2026, directing the State to grant the benefits along with arrears and pensionary entitlements.


The State's review petition argued that the original order contained an error apparent on the face of the record due to the unconsidered delay. However, Justice Pillai clarified that a review is not an appeal and is only maintainable in cases of glaring omissions or patent errors. The court found no such errors, reaffirming that the delay was due to the State's failure to act, not the employee's inaction.


The judgment also highlighted that the principle of delay and laches does not apply when the employer's inaction causes deprivation of benefits. The court distinguished this case from other precedents cited by the State, noting that the ongoing deprivation was due to the department's continuous failure to extend rightful pay fixation and pensionary benefits.


This decision underscores the judiciary's commitment to ensuring that employees are not penalized for delays attributable to administrative lapses and reaffirms the principle that employees should receive statutory and policy benefits owed to them.
