Adventure Sports Award Controversy Resolved as Court Finds No Merit in Petitioner’s Claims


In a significant ruling, the Madhya Pradesh High Court, Indore Bench, presided over by Justice Pranay Verma, dismissed the writ petition filed by Madhusudan Patidar challenging the decision of the State of Madhya Pradesh to confer the Vikram Award in the Adventure Sports Category to another candidate. The petitioner, who summited Mount Everest in 2017, contended that he was unfairly overlooked for the prestigious award due to non-compliance with the Award Rules, 2021 by the state authorities.


The petitioner argued that the selection process was arbitrary and discriminatory, alleging that his achievement of summiting Mount Everest should have been prioritized over the respondent who completed the feat in 2019. The crux of the petitioner’s argument was based on the seniority and priority clauses within the Award Rules, 2021, which emphasize achievements within the last five years.


However, the court found that the petitioner’s claim was ineligible as his achievement fell outside the five-year consideration period stipulated by the rules. The court noted that the petitioner’s expedition in 2017 did not meet the eligibility criteria for the 2023 award, which considered achievements from April 1, 2018, to March 31, 2023.


Further, the court upheld the procedural compliance by the state authorities in inviting applications for the award. It was clarified that the state fulfilled its obligations by issuing public notices and press releases, thereby sufficiently informing potential applicants. The court dismissed allegations of procedural irregularities, highlighting that the petitioner had indeed participated in the application process for 2023, indicating effective communication by the authorities.


In concluding the judgment, Justice Verma stated that the petitioner failed to demonstrate any violation of the award rules or procedural lapses by the state. Thus, the petition was found to be devoid of merit and was dismissed, reaffirming the decision to award the Vikram Award to the respondent.
