M. Appavu Declared Duly Elected as Court Upholds Headmasters as Gazetted Officers


In a landmark judgment, the Madras High Court has declared the election of I.S. Inbadurai from the 228 Radhapuram Assembly Constituency as void, citing the improper rejection of 203 postal ballots attested by headmasters of middle schools. The court has declared M. Appavu as the duly elected representative for the 2016-2021 term.


The legal battle, which spanned nearly a decade, centered on the validity of postal ballots attested by middle school headmasters. The Representation of People Act, 1951, mandates that postal ballots must be attested by Gazetted Officers. The court ruled that headmasters of middle schools qualify as Gazetted Officers under relevant election laws.


The case highlighted significant procedural delays in election dispute resolutions, with the court emphasizing the need for expeditious disposal of such cases. Justice G. Jayachandran criticized the six-year delay in adjudicating the petition, which undermines democratic principles and the timely resolution of election disputes.


The judgment also pointed out that the improper rejection of postal ballots materially affected the election result. The court ordered a recount and found that Appavu had received 153 valid postal votes, overturning the narrow margin by which Inbadurai was initially declared the winner.


The Supreme Court had previously kept open the question of whether headmasters are Gazetted Officers, but the Madras High Court reiterated its stance, asserting that their attestation is valid under existing rules.


The decision underscores the importance of adhering to electoral laws and the role of the judiciary in upholding democratic integrity. The court also directed the Secretary of the Tamil Nadu Legislative Assembly to update official records to reflect Appavu as the elected representative for the stated term.
