Employee's Attempt to Delay Promotion for Special Grade Benefits Denied by Court
In a significant ruling, the Madras High Court, Madurai Bench, dismissed an appeal filed by M. Balasubramanian, challenging the denial of special grade benefits following his promotion. The Division Bench, comprising Mr. N. Sathish Kumar and M. Jothiraman, JJ., upheld the decision of the Accountant General (A&E) to revise the pay fixation of the appellant.
The appellant, initially appointed as an Agricultural Officer, completed 20 years of service on January 20, 2013, and was granted a selection grade from that date. However, he was promoted to the post of Assistant Director on December 17, 2012. Instead of assuming his new role immediately, Balasubramanian went on medical leave and took charge only on January 20, 2013, coinciding with his completion of 20 years of service.
The crux of the appellant's argument was his entitlement to the special grade benefits due to his 20 years of service. The promotion order was communicated while he was on medical leave, and he claimed that upon rejoining, he should receive the special grade benefits.
The court, however, noted that once an employee is promoted before completing the qualifying period, they are not entitled to special grade benefits. The appellant's delay in assuming the promotional post was seen as a strategic move to gain such benefits, which the court deemed unjustifiable.
The learned Single Judge previously dismissed the writ petition on similar grounds, stating that Balasubramanian, having been promoted, was no longer eligible for the special grade in his previous position as an Agricultural Officer. The Division Bench found no merit in the appeal and confirmed the decision to revise the pay fixation, thereby rejecting the appellant's claims.
This judgment reinforces the principle that promotions must be accepted as they occur, and attempts to manipulate service timelines for personal benefit will not be entertained by the judiciary.

An employee promoted before completing the qualifying period for a special grade cannot claim entitlement to the special grade benefits, even if there is a delay in assuming the promotional post.
