Employees Appointed After Administrative Delays Entitled to Old Pension Scheme, Rules Court
In a significant judgment, the Madras High Court has ruled in favor of employees who faced administrative delays in their appointments, affirming their entitlement to the old pension scheme. The case, titled "The Commissioner, Madurai Corporation v. K. Nalayini," was decided by a division bench of Justices N. Sathish Kumar and M. Jothiraman.
The court addressed the issue of whether employees, who were part of the same selection process and were delayed in appointment due to administrative inaction, should be covered under the old pension scheme applicable before the cutoff date of April 1, 2003. The decision came after a writ appeal was filed by the Commissioner of Madurai Corporation against a previous order that favored maintaining the old pension scheme for the respondent, K. Nalayini.
The controversy arose when K. Nalayini, who was appointed after the cutoff date due to administrative delays, was asked to switch to the new pension scheme. The court underscored that administrative delays should not result in discrimination among employees selected in the same batch. The court noted that the respondent was placed under the old pension scheme for over two decades and had been treated on par with similarly placed individuals.
The court emphasized that administrative errors should not strip employees of their rightful benefits, especially when the delay in appointment was not their fault. It was highlighted that the respondent, along with others, was selected in 1999, but the appointment was delayed until 2003 due to inaction by the authorities.
The bench further stated that the administrative delay should not deprive employees of the rights conferred by previous court orders and pension rules applicable at the time of selection. The court dismissed the appeal, reinforcing that the respondent's entitlement to the old pension scheme was valid and should remain unchanged.
This judgment sets a precedent for cases where employees face similar circumstances, ensuring that administrative inefficiencies do not penalize employees by altering their pension entitlements.
