Orissa High Court Dismisses Misuse of Habeas Corpus in Matrimonial Dispute

Court imposes Rs. 50,000 fine for attempting to pressure spouse through legal proceedings.


In a significant ruling, the Orissa High Court has dismissed a habeas corpus petition filed by Shri Lambodar Patra against the State of Odisha, citing misuse of the writ to exert pressure in a matrimonial dispute. The court, led by Chief Justice Harish Tandon and Justice M.S. Raman, emphasized that the writ of habeas corpus is not a tool for settling personal scores or coercing a spouse to return to the matrimonial home.


The petitioner, Shri Lambodar Patra, sought to utilize the habeas corpus writ to compel his wife, who had voluntarily left the matrimonial home due to alleged disharmony, to return. The court, however, found this approach to be an abuse of the judicial process, highlighting that the writ cannot be used to force a spouse's presence in matrimonial disputes.


The court noted that the wife, being an adult capable of making her own decisions, could not be treated as property in the hands of her husband. The bench observed that the increasing trend of filing habeas corpus petitions in such contexts represents a device to settle personal scores rather than a genuine legal recourse.


Relying on the petitioner's own statement, the court confirmed that the wife left the matrimonial home voluntarily, corroborating the misuse of the writ. The bench condemned the petitioner for not approaching the court with clean hands, accusing him of creating an illusory cause of action through clever drafting.


The judgment, pronounced on June 22, 2026, concludes with the dismissal of the petition and imposes a cost of Rs. 50,000 on the petitioner. The court directed that this amount be deposited with the State Legal Services Authority within two weeks, to be allocated for juvenile welfare.


The ruling reinforces the sanctity of the writ of habeas corpus, underscoring its intended purpose and discouraging its exploitation in personal disputes.
