Orissa High Court Quashes Disengagement of Scheduled Caste Employee; Orders Reinstatement with Benefits

State of Odisha to Pay Rs. 50,000 Exemplary Costs for Arbitrary Actions Against Employee

In a landmark judgment, the Orissa High Court has quashed the arbitrary disengagement of Debendra Nath Malik, a Scheduled Caste employee, and directed the State of Odisha to reinstate him with all consequential service and financial benefits. The court also imposed an exemplary cost of Rs. 50,000 on the State for its capricious and mindless actions against Malik, who has been embroiled in multiple legal battles despite consistent favorable judgments.

The division bench, comprising Justices Mr. Krishna Shripad Dixit and Chittaranjan Dash, upheld the decision of a Single Judge, emphasizing the unjust nature of Malik's disengagement. The court noted that Malik, who was engaged through a proper recruitment process and had an impeccable service record, was subjected to unjust treatment, reflecting a lack of application of mind by the authorities.

The State, represented by Mr. S.B. Mohanty, AGA, argued that Malik's initial appointment was invalid due to a prior judgment quashing the recruitment process. However, the court found these claims meritless, reaffirming that Malik's selection was legitimate and within the quota reserved for Scheduled Caste candidates.

Highlighting the historical context of caste discrimination, the judgment underscored the importance of affirmative action policies designed to uplift marginalized communities. The court criticized the State's repeated attempts to disengage Malik, describing them as actions lacking legal and moral justification.

The court's decision mandates compliance within eight weeks, warning of potential contempt proceedings for non-compliance. This judgment serves as a reminder of the judiciary's role in safeguarding the rights of marginalized individuals and ensuring that state actions align with principles of justice and equality.

Bottom Line:

Service Law - Scheduled Caste employee's disengagement quashed - Direction to reinstate with all consequential service and financial benefits - Exemplary cost of Rs. 50,000/- imposed on the State for arbitrary and capricious treatment of the employee and repeated litigation.
