The judgment, delivered by Justices Dipankar Datta and Augustine George Masih, overturned a decision by the Orissa High Court which had directed the State to convene a Departmental Promotion Committee (DPC) for considering promotions to the post of Assistant Regional Transport Officer (ARTO).
The case arose when two government employees, Sreepati Ranjan Dash and Aditya Bhanjan Sahoo, sought promotion to the position of ARTO under executive instructions from 1981, which were in place prior to the enactment of the Odisha Transport Service Rules, 2021. The High Court had previously ruled in favor of the employees, directing the State to consider their promotions under the earlier executive instructions. However, the Supreme Court clarified that once statutory rules are framed under Article 309 of the Constitution, they supersede all prior executive instructions.
The apex court reaffirmed the principles laid out in the case of Raj Kumar (2023) 3 SCC 773, which overruled the earlier precedent set by Y.V. Rangaiah (1983), stating that vacancies should be filled according to the rules in force at the time of consideration, not when they arose.
The judgment highlighted that the restructuring of the cadre, which elevated the post of ARTO to a selection post filled through competitive exams, was a policy decision well within the State's discretion. The court emphasized that such policy decisions cannot be challenged unless proven arbitrary.
