The trial court had subsequently declared him an absconder and initiated proceedings under Sections 82 and 83 of the Criminal Procedure Code (Cr.P.C.), issuing a permanent warrant for his arrest.


The High Court, upon reviewing the petition filed by Khan, noted that while his absence contributed to delays, the trial court's decision to declare him an absconder was hasty and lacked adherence to necessary procedural steps. The judgment emphasizes that declaring an accused as absconding is a serious legal measure requiring strict compliance with procedural norms to balance securing the accused's presence and maintaining fairness in judicial processes.


Justice Ali directed that Khan must present himself before the trial court by April 27, 2026, to seek regular bail. Upon his appearance, the proceedings under Sections 82 to 85 of the Cr.P.C. will be recalled, and the arrest warrant will be withdrawn. The court further ordered that Khan should not be arrested until the stipulated date, provided he adheres to the timeline.
