Court endorses arbitrator's interpretation of contract terms; rejects Union of India's appeal over delay and misconduct claims


In a significant judgment dated April 30, 2026, the Rajasthan High Court, presided over by Justice Sandeep Shah, upheld the decisions of an arbitrator regarding contract disputes between the Union of India and Shri. V. S. Saini. The case revolved around the interpretation of terms in a contract for construction work along the Indo-Pak border. The arbitrator's interpretation of the term "either" as meaning "one side" rather than "both sides" was upheld as reasonable. The court found no misconduct by the arbitrator under Section 30 of the Arbitration Act, 1940, which limits interference to cases of misconduct, invalidity, or illegality.


The dispute arose from contracts issued in 1991-92 for constructing security fencing. Differences in contract interpretation, particularly the meaning of "either" in the context of strutting posts, were central to the case. The arbitrator awarded costs to the claimant for materials not supplied by the Union of India, which the court confirmed as justified.


The High Court also dismissed the Union of India's appeal for condonation of a 117-day delay in filing objections, stating that administrative delays due to a change in government did not constitute sufficient cause. The court underscored the necessity for rigorous explanations in arbitration-related delays.
