Election Commission's Jurisdiction Limited; Civil Court to Decide on Symbol Allocation Dispute Promptly
In a landmark decision, the Supreme Court of India has ruled that the Election Commission of India does not have the jurisdiction to decide disputes regarding the allocation of symbols among rival factions of unrecognized political parties. The Court has directed that such matters should be resolved by Civil Courts, ensuring that aggrieved parties have access to timely judicial remedies.
The case, brought forth by M/s. Pattali Makkal Katchi, involved a dispute over the allocation of a party symbol amidst internal rivalry. The petitioner argued that the Election Commission should intervene, but the Supreme Court affirmed the High Court's view that such disputes fall outside the purview of the Commission.
The Bench, comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice Vipul M. Pancholi, emphasized the importance of providing a legal avenue for resolution to prevent parties from being left without recourse. The petitioner has already initiated a civil suit, and the Supreme Court has instructed the Civil Court to expedite the process, directing it to decide the application within three days if submitted promptly.
Furthermore, the Supreme Court has granted liberty to all involved parties to present their arguments in the Civil Court, ensuring a comprehensive examination without prejudging the merits of the case.
This decision underscores the judiciary's commitment to ensuring that political disputes, particularly those involving unrecognized parties, are resolved through appropriate legal channels, reinforcing the role of Civil Courts in maintaining electoral fairness and justice.
Bottom Line:
Dispute regarding allocation of symbol among two rival groups of an unrecognized political party cannot be decided by the Election Commission of India. Civil Court is the appropriate forum for such matters.
