Aadya Prasad Tiwari, accused under Sections 306 (abetment of suicide), 120B (criminal conspiracy), and 302 (murder) of the Indian Penal Code, was arrested on September 22, 2021. The case, registered at Police Station George Town in Prayagraj, has seen a prolonged trial process with a substantial list of 150 witnesses proposed by the prosecution. Despite the charge sheet being filed over four years ago, only three witnesses have been examined so far, indicating that the trial is likely to continue for an extended period.
The Supreme Court observed that Tiwari does not appear to be the principal accused in the case, making his continued detention unnecessary. Emphasizing the importance of justice and fair trial, the Court stated that further detention of the appellant pending trial was unwarranted, given the circumstances.
The bench set aside the High Court's judgment and ordered Tiwari's release on bail, subject to conditions set by the trial court. These conditions include the requirement that Tiwari must not dissuade witnesses from testifying and must diligently attend trial proceedings unless exempted. The trial court retains the authority to cancel bail if these conditions are breached.
Importantly, the Supreme Court clarified that the observations made in its order are not to be construed as findings on the merits of the case. The appeal was thus allowed, marking a notable decision in the ongoing legal proceedings.
