Uttarakhand High Court Grants Anticipatory Bail in Cow Slaughter Case

Chota alias Dalla secures bail under strict conditions; accused claims false implication

In a significant legal development, the Uttarakhand High Court has granted anticipatory bail to Chota alias Dalla, who was accused under the Uttarakhand Protection of Cow Progeny Act, 2007, for alleged cow slaughter. The decision was delivered by Justice Sri Alok Kumar Verma on November 11, 2025, amidst claims of false implication by the applicant.

The bail application was initially rejected by the Ist Additional Sessions Judge, Roorkee, on October 30, 2025. The case originates from an incident reported on October 23, 2025, where the police were informed about alleged cow slaughter by Chota, Abdul Rahman alias Dulla, Imran alias Tailor, and Ikrar. A subsequent police raid resulted in the recovery of 210 kg of beef and other articles, leading to the arrest of Abdul Rahman and Ikrar, while Chota and another suspect evaded capture.

Counsel for the applicant, Mr. Rajveer Singh, argued that Chota was not present at the crime scene, asserting his innocence and lack of criminal history. It was highlighted that a co-accused, Imran alias Tailor, was previously granted anticipatory bail, bolstering the applicant's claim for similar relief.

Despite opposition from the State's representative, Mr. Akshay Latwal, the court allowed the bail, imposing stringent conditions including a personal bond of Rs. 30,000 and two sureties of the same amount. The conditions mandate Chota's cooperation with the investigation, regular attendance at trial proceedings, abstaining from any form of inducement, and prohibition from leaving the country without court permission.

The court emphasized that any breach of these conditions could lead to the cancellation of bail. This decision underscores the judiciary's balanced approach in safeguarding individual rights while ensuring adherence to legal procedures.

Statutory provision(s): Criminal Procedure Code, 1973 Section 438, Uttarakhand Protection of Cow Progeny Act, 2007 Sections 3, 5, 11.
