Court Emphasizes Timely Constitution of Departmental Promotion Committees and Dismisses Petitioners' Appeal


In a significant ruling, the Uttarakhand High Court has upheld the rejection of claims made by several Nursing Officers from AIIMS, Rishikesh, who sought retrospective promotions to the position of Senior Nursing Officer. The court emphasized the importance of timely Departmental Promotion Committee (DPC) evaluations for promotions and dismissed the petition challenging the administrative decision.


The case, titled "Ravin Kumar Bishnoi and Others v. Union of India," was decided by Justice Manoj Kumar Tiwari. The petitioners, represented by Ms. Prabha Naithani and Avidit Noliyal, contended that they were entitled to promotions after completing three years of service by 2021. However, their request was denied by the AIIMS administration, which cited the absence of any provisions or guidelines supporting retrospective promotions.


The petitioners were originally appointed as Nursing Officers during 2017-18 and were subsequently promoted to Senior Nursing Officers by an order dated August 17, 2022. Their claim for retrospective promotion from 2021 was based on the Office Memorandum dated September 8, 1998, which outlines the need for DPCs to be convened regularly to address promotions against vacancies.


In the judgment, the court noted that the Office Memorandum does not provide for promotions from a deemed or retrospective date. Promotions are determined by available vacancies and the recommendations of the DPC. The court further highlighted that the DPC responsible for assessing the petitioners' eligibility was constituted in 2022, which led to their promotions, thus making their claim for a 2021 promotion unsustainable.


Justice Tiwari reiterated that in the absence of specific provisions for retrospective promotion, the petitioners' appeal could not be granted. The court dismissed the writ petition, stating that the administrative decision to reject the retrospective promotion claim was valid.


The judgment also calls for adherence to the instructions in the Office Memorandum, urging the competent authority at AIIMS to ensure that DPCs are convened in a timely manner to prevent delays in promotions.

Promotion cannot be claimed retrospectively or from a deemed date in the absence of specific provisions or guidelines. Departmental Promotion Committees (DPCs) must assess eligibility, and promotions are vacancy-based on DPC recommendations.
