Prayagraj, Sep 3 The Allahabad High Court on Thursday gave relief to Uttar Pradesh minister Suresh Khanna as it dismissed a criminal revision challenging the order of the MP-MLA Mathura court.
The trial court had dismissed an application of the petitioner seeking registration of an FIR against Khanna.
The judgment was passed by Justice Vikram D Chauhan, who dismissed a petition filed by the Sanatan Dharma Rakshapeeth as well as by Kaushal Kishore Thakurji Maharaj.
According to the facts, the petitioners filed an application under Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) (which provides a legal remedy when a police station officer refuses to record a First Information Report (FIR) before the Mathura court.
The petitioners alleged that an FIR has been registered against one Nirvikar Singhal in 2022 under Sections 120B, 166, 420, 467, 468 and 471 of the Indian Penal Code (IPC) relating to a land in dispute earlier recorded in the name of Sant Kuti Manav Sewa Sansthan.
The matter is being investigated by the UP Vigilance Department at Meerut. It was alleged that Khanna was interfering in the investigation and, therefore, an application was moved to register an FIR against the minister.
The Additional Chief Judicial Magistrate (MP-MLA court), Mathura, on June 6, 2025, rejected the application by saying that according to the petitioner himself regarding the disputed property, an FIR was registered at Meerut and the matter was being investigated by the Vigilance Department, Meerut.
Thus, if any interference was being alleged by Khanna, then the cause of action arose at Meerut and not at Mathura.
