Allahabad High Court Calls for Strict Implementation of Clinical Establishments Act

Directs National and State Councils to Ensure Compliance and Address Fee Disparities


In a significant move aimed at reforming the healthcare system, the Allahabad High Court, Lucknow Bench, has issued comprehensive directives for the implementation of the Clinical Establishments (Registration and Regulation) Act, 2010. The court has underscored the necessity for the effective functioning of both the National and State Councils established under the Act to ensure that clinical establishments comply with statutory standards and regulations.


The Division Bench, comprising Justices Rajan Roy and Manjive Shukla, passed the order while hearing a Public Interest Litigation (PIL) filed by "We The People" through its General Secretary, Prince Lenin. The PIL sought enforcement of the Act to regulate clinical establishments, including private hospitals, with a focus on standard maintenance, fee regulation, and addressing grievances.


The court has directed the impleadment of the National and State Councils as parties to the proceedings. It has also sought affidavits from these bodies regarding their compliance with the Act’s provisions. The court specifically emphasized the need for the councils to develop and periodically review minimum standards for clinical establishments, as mandated by the Act.


Moreover, the court has highlighted the issue of fee disparity among private clinical establishments. It instructed the Union and State Governments to ensure uniformity and rationality in the fees charged, in compliance with Rule 9 of the Clinical Establishments (Central Government) Rules, 2012. The court has pointed out the necessity for transparency in the display and regulation of rates, along with adherence to Standard Treatment Guidelines.


The District Registering Authority of Lucknow has been directed to submit a report detailing the inspections conducted under Section 33 of the 2010 Act and the actions taken over the past five years. The court has stressed the importance of effective performance of obligations by the authorities in the larger public interest.


Addressing the issue of grievance redressal, the court has mandated the State Government to provide immediate mechanisms for patients to address deficiencies in services, particularly in private hospitals. The court has also sought data on private hospitals established with government aid, emphasizing the conditions related to treatment for economically weaker sections.


The court is set to monitor the progress of these directives in subsequent hearings, with the next date scheduled for September 21, 2026.
