Allahabad High Court Dismisses Revision Petition in Landlord-Tenant Dispute

The court affirms that a third party claiming independent title cannot be impleaded in a Small Causes Suit where the title's determination is not essential to the dispute.

In a significant ruling, the Allahabad High Court dismissed a revision petition filed by Manish Bansal, who sought to be impleaded in a Small Causes Suit involving a landlord-tenant dispute. The judgment, delivered by Justice Dr. Yogendra Kumar Srivastava, emphasized that a person claiming an independent title in the subject property cannot insist on being included in the proceedings if the determination of such title is neither necessary nor relevant to the adjudication of the dispute at hand.

The case originated from a Small Causes Suit concerning a shop located on the ground floor of a two-storey building, originally owned by the late Jagdish Prasad Mittal. The revisionist, Manish Bansal, claimed rights over the property based on an unregistered Will allegedly executed by the deceased Mittal in his favor. However, the plaintiff in the original suit, Jagdish Prasad Mittal, contested this claim, asserting exclusive rights over the property through a registered Will.

Bansal's application for impleadment was previously rejected by the Additional District Judge, Court No.1, Bulandshahr, leading to the present revision petition. The court observed that Bansal's claim, based on the unregistered Will, did not affect the landlord-tenant relationship central to the Small Causes Suit. The court further noted that Bansal had already initiated separate proceedings seeking a declaration of his rights based on the contested Will, which is the appropriate forum for such claims.

In its judgment, the High Court clarified that the assertion of an independent title does not make one a necessary or proper party to a Small Causes Suit, especially when the adjudication of such a claim is not required for resolving the dispute. The ruling underscores the principle that Small Causes Courts are not the venue for determining complex title issues, which should be addressed in appropriately instituted proceedings.

This decision reaffirms the limited scope of Small Causes Court proceedings, focusing on landlord-tenant relationships without delving into broader property title disputes. The court's dismissal of the revision petition reinforces the need for proper adjudication channels for independent title claims, ensuring that such disputes do not encumber or delay the resolution of landlord-tenant issues.

Bottom Line :

A person claiming independent title in the subject property cannot insist on being impleaded in a Small Causes Suit where determination of such title is neither necessary nor germane to the adjudication of the landlord-tenant dispute forming the subject matter of the suit.
