Allahabad High Court Dismisses Student's Appeal Seeking Multiple Reliefs Including Promotion After Failure

Court warns habitual litigant against frivolous petitions and upholds Single Judge's order denying vague and unsupported claims, while allowing leniency for supplementary exam appearance

In a recent judgment dated October 13, 2026, the Allahabad High Court (Division Bench) dismissed the intra-court appeal filed by Prashant Tiwary, a student of the University of Allahabad, who sought a slew of reliefs including quashing of his failed B.A. Part-I examination, promotion to the second year, revision of the university curriculum, renovation of college hostels, appointment of an independent inquiry committee, and compensation for mental agony.

The appellant, who had failed the first-year examination held in 2024 and subsequently discontinued his studies, had filed a writ petition which was earlier dismissed by a Single Judge of the High Court on October 15, 2025. The Single Judge's order had categorically held that except for the part of the prayer seeking promotion to the second year, the other reliefs were vague, general in nature, and did not pertain to any enforceable personal grievance of the appellant. The Single Judge also observed that if the appellant's marks-sheet was withheld without sufficient reason, it should be provided to him, and he could be allowed to appear in supplementary or fresh examination in 2026, subject to legal regulations.

The appellant challenged this order through an appeal filed beyond the stipulated time, which was condoned by the Division Bench due to the absence of any objection from the respondents. Appearing in person, the appellant contended that the Single Judge erred in denying his claims, especially since no counter affidavit was filed by the University. He also argued that the University did not comply with University Grants Commission (UGC) guidelines on curriculum and examination conduct, warranting judicial intervention.

The University, through its counsel, countered that the appellant was a habitual litigant who had engaged in multiple unwarranted and misconceived proceedings instead of focusing on academics. The court was informed that the appellant had previously obtained his marks-sheet after court intervention and had even filed separate compensation claims, which were dismissed. The University highlighted the appellant's repeated filing of frivolous petitions and use of objectionable language against judicial officers.

After examining the pleadings and submissions, the Division Bench upheld the Single Judge's order. The court noted that except for the promotion request, all other reliefs were general in nature and unrelated to the appellant's personal grievance, thus unsuitable for writ relief. The court appreciated the Single Judge's leniency in granting the appellant permission to appear in supplementary or fresh examinations, despite no such relief being specifically claimed.

The judgment also pointed out the appellant's apparent lack of interest in continuing his studies and his preference for litigation. The court admonished the appellant for his conduct and warned that continued frivolous litigation might attract adverse orders in the future.

Ultimately, the appeal was dismissed with a clear warning to the appellant to refrain from filing baseless petitions and to focus on his academic pursuits.

Bottom Line:

Writ petition containing vague, general and unsupported prayers, not relating to any enforceable personal grievance of the petitioner, is liable to be rejected. Intra-court appeal against dismissal of such petition also deserves dismissal, and Court may warn litigant against filing frivolous petitions and using objectionable language against judicial officers.
