The habeas corpus writ petition filed by Dr. Jaiswal alleged illegal custody of his five-year-old daughter by her mother, Chandani Jaiswal, raising concerns over the child's mental and physical welfare.


In previous proceedings, Dr. Jaiswal was granted visitation rights via video conferencing, which he claimed were obstructed by the private respondents, thereby restricting meaningful interaction with his daughter. The petitioner's counsel argued that the child was heavily tutored by her mother, exposing her to abusive and sexual content inappropriate for her age, thereby jeopardizing her welfare.


During the court's interaction with the minor, allegations of sexual abuse by the father were revealed. However, the court found these claims to be tutored by the mother, noting that the descriptions provided by the child were beyond her age and comprehension. Justice Jain emphasized the paramount importance of the child's welfare, stating that tender-aged children should not be used as pawns in matrimonial disputes.


The court observed that the minor's current environment under her mother's custody was not conducive to her well-being, leading to the decision to temporarily transfer custody to Dr. Jaiswal until the next hearing scheduled for August 17, 2026. During this interim period, the mother, Chandani Jaiswal, is permitted to visit and communicate with the child through video conferencing, with assurances from the father to facilitate these interactions.


The ruling underscores the court's focus on the child's welfare over parental disagreements, reiterating that the minor should not be influenced by ongoing matrimonial disputes. Both parties are directed to ensure the child's safety and security, with the court retaining jurisdiction for further hearings.
