In a significant development, the Allahabad High Court has modified the stringent bail conditions imposed on Alice Lee, a Chinese national accused of Goods and Services Tax (GST) evasion. The decision came after the Chinese Embassy in India refused to issue a guarantee certificate for her bail, citing limitations within its consular responsibilities.


Alice Lee, who has been in jail since August 2025, was granted bail in February 2026 with conditions that included securing a guarantee certificate from her country's embassy. However, the embassy's refusal necessitated a reassessment of her bail terms. The High Court, while acknowledging the practical challenges faced by the applicant, modified the conditions to ensure her compliance with trial proceedings.


Justice Samit Gopal, presiding over the matter, noted that Lee's visa status had been regularized with an X-Misc. visa, specifically for foreign nationals involved in criminal cases and required to attend court proceedings in India. The visa, valid until October 2026, includes a restriction on departure without an exit permit.


The revised bail conditions now require Alice Lee to submit an undertaking to the trial court, affirming her commitment to appear at all court dates and cooperate with the trial proceedings. Additionally, she must provide periodic updates on her whereabouts within the country, ensuring that the trial court remains informed.


The court's decision underscores the balance between legal compliance and addressing the practical difficulties faced by foreign nationals in Indian judicial processes. The modification aims to facilitate Lee's participation in her trial while considering her status as a foreign national and a mother of a minor child.
