Allahabad High Court Rules Against Recovery of Excess Payments from Retired Employee

Court Orders Refund of Deducted Retiral Benefits with Interest, Citing Violation of Constitutional Rights

In a significant judgment, the Allahabad High Court has ruled against the recovery of excess payments from the retiral benefits of Brijesh Singh Dagar, a retired police officer. The court ordered the State of Uttar Pradesh to refund the deducted amount of Rs.11,51,840 along with 7% simple interest, emphasizing the protection of retiral dues under Article 21 of the Constitution of India.

The petitioner, Brijesh Singh Dagar, retired as a Head Constable (Driver) after serving in the police force since 1984. Before his retirement on July 31, 2025, he was notified of a pay scale revision, which he had never requested. Despite his explanation, the authorities refixed his salary and recovered the alleged excess payment from his retiral benefits.

The court, presided over by Justice Manish Kumar Nigam, highlighted that recoveries from retired employees are impermissible if the excess payments resulted from the employer's mistake, without any fraud or misrepresentation by the employee. The judgment referenced several Supreme Court rulings, including State of Punjab v. Rafiq Masih and Thomas Daniel v. State of Kerala, which established that such recoveries cause undue hardship and infringe upon the right to life with dignity.

The High Court also underscored that retiral benefits are not mere bounties but earned rights, and any deductions from them due to employer errors are arbitrary. The court criticized the prolonged delay in correcting the pay fixation, which spanned 17 years, as inequitable and unjust.

This decision reaffirms the judiciary's stance on safeguarding the financial security and dignity of retired employees, ensuring that they are not penalized for administrative oversights.

Bottom Line :

Recovery of excess payment made to an employee due to erroneous pay fixation, without any misrepresentation or fraud on the part of the employee, and after a prolonged period of time, is impermissible under law. Retiral dues are considered as a hard-earned right and are protected under Article 21 of the Constitution of India.

Statutory provision(s): Article 21 of the Constitution of India, Judicial precedents including State of Punjab v. Rafiq Masih, Thomas Daniel v. State of Kerala, and other relevant Supreme Court and High Court judgments.
