Court Dismisses Challenge to Election Petition Filed After Summer Break, Citing Uttar Pradesh General Clauses Act, 1904

The court noted that since the courts were closed for summer vacation, the election petition filed on the first working day after the vacation was valid.

Justice Budhwar emphasized that the absence of any specific notification allowing the filing of election petitions during vacations or holidays reinforced the validity of the petition filed post-vacation. The court found no manifest illegality in the lower court's decision to accept the election petition, thereby dismissing Nigam's writ petition.
