Allahabad High Court Upholds Maintenance of Rs. 3,500/- per Month to Wife under Section 125 CrPC

Court Reaffirms Husband's Obligation to Maintain Legally Wedded Wife Despite Financial Constraints, Emphasizing Wife's Right to Live with Dignity

In a significant judgment dated September 30, 2026, the Allahabad High Court dismissed a criminal revision petition filed by Mohammad Kamil challenging the order of the Nyayadhikari, Gram Nyayalay, Patiyali, Kasganj, which directed the petitioner to pay Rs. 3,500 per month as maintenance to his legally wedded wife under Section 125 of the Criminal Procedure Code, 1973 (CrPC).

The husband had contended that his wife was residing separately without any valid reason and that he lacked a permanent source of income, rendering him incapable of paying the maintenance amount. He also argued that the trial court erred in granting maintenance from the date of the application without assigning specific reasons.

The Court, presided over by Justice Jai Krishna Upadhyay, thoroughly examined the submissions and the entire case record. It reiterated the fundamental purpose of Section 125 CrPC, which is to provide relief to wives who have been compelled to leave their matrimonial homes due to neglect or cruelty and to ensure that they are not left destitute or compelled to beg for sustenance.

The judgment emphasized that the husband's plea of financial incapacity or lack of permanent income is generally unacceptable in law, as long as he is capable of earning. The Court highlighted that the wife is entitled to live with dignity and in a manner consistent with the status she enjoyed during her matrimonial life. The amount of maintenance must be adequate to enable her to maintain reasonable comfort but should not be excessive.

The Court referred to precedents including Jabsir Kaur Sehgal v. District Judge Dehradun (1997) 7 SCC 7, which laid down the principles to be considered for determining the quantum of maintenance - status of the parties, needs, and the husband's capacity after reasonable expenses. It also cited Chaturbhuj v. Sita Bai (2008) 2 SCC 316, which recognized maintenance to a wife as an essential measure of social justice.

The trial court's findings that the wife was unable to maintain herself and had been turned out of the matrimonial home due to non-fulfillment of dowry demands were upheld. The Court found the maintenance amount of Rs. 3,500 per month to be a modest sum, not exorbitant, and justified from the date of application.

In conclusion, the Allahabad High Court held that the impugned maintenance order was legal, justified, and did not suffer from any jurisdictional error or perversity. The revision petition was dismissed, reinforcing the legal obligation of the husband to maintain his wife and underscoring the protective intent of Section 125 CrPC to ensure the wife's right to a dignified life.

Bottom Line:

Section 125 Cr.P.C. - Maintenance to wife - Husband cannot avoid liability to maintain his legally wedded wife on the plea of lack of permanent income or financial constraints, so long as he is capable of earning - Maintenance must be adequate to enable wife to live with dignity and may validly be awarded from the date of application - Award of Rs. 3,500/- per month upheld.
