In a significant ruling, the Andhra Pradesh High Court has increased the compensation awarded to the family of Mamidi Satyanarayana, who tragically died in a bus accident in 2009, from Rs. 3.85 lakh to Rs. 8.40 lakh. The decision, delivered by Justice A. Hari Haranadha Sarma, highlights the court's commitment to ensuring just compensation for victims despite statutory caps.


The case stemmed from an incident on July 13, 2009, when Satyanarayana was fatally injured at the Nellore-Atmakur Bus Stand while attempting to reserve a seat on a moving bus operated by A.P.S.R.T.C. The Motor Accidents Claims Tribunal (MACT) initially awarded Rs. 3.85 lakh, which was contested by both the A.P.S.R.T.C. and the claimants.


The court found negligence on the part of the bus driver, affirming the MACT's decision but noted that the statutory caps under Section 163-A of the Motor Vehicles Act, 1988 were outdated and inadequate. The court applied the principles of just compensation, considering socio-economic changes and inflation, to enhance the compensation.


The enhanced compensation includes Rs. 6.50 lakh for loss of dependency, Rs. 1.60 lakh for loss of consortium, and additional amounts for funeral expenses and loss of estate. The court also reduced the interest rate from 9% to 7.5% per annum.


This ruling underscores the judiciary's role in adapting legal principles to contemporary realities, ensuring victims receive fair compensation. The decision sets a precedent for considering socio-economic changes and inflation in compensation cases, potentially influencing future judgments.
