Andhra Pradesh High Court Full Bench Clarifies Time Limit for Submission of Form 'H' under Central Sales Tax Act

Submission of Form 'H' for claiming export sales exemption must be done before assessment completion; time extensions applicable to Forms 'C' and 'F' do not apply to Form 'H'

In a significant ruling impacting commercial tax procedures in Andhra Pradesh, the Full Bench of the Andhra Pradesh High Court has clarified the procedural timelines for submission of Form 'H' under the Central Sales Tax (CST) Act, 1956. The judgment, delivered on October 8, 2026, resolves a long-standing dispute on whether the extended time limits available for Forms 'C' and 'F' also apply mutatis mutandis to Form 'H', which is critical for claiming tax exemption on penultimate export sales.

Background and Issue:

The CST Act provides exemptions for sales made in the course of export, with Form 'H' serving as a mandatory declaration by exporters to claim such benefits under Section 5(3) read with Section 5(4) of the CST Act. However, unlike Forms 'C' and 'F'-which enjoy a three-month window post-period end for submission under Rule 12(7) of the CST (Registration and Turnover) Rules, 1957-there was ambiguity regarding the time frame for Form 'H'. Many dealers submitted Form 'H' after the assessment proceedings had concluded, invoking parity with Forms 'C' and 'F' based on Rule 12(10)(b), leading to disputes and tax demands.

Court's Analysis:

The Full Bench, led by Justice Sri Battu Devanand, examined the statutory provisions, previous Division Bench orders, and relevant Supreme Court precedents to determine the correct interpretation of Rule 12(10) of the CST Rules, 1957. The court noted:

  • 1. Rule 12(10)(a) explicitly states that Form 'H' must be furnished "up to the time of assessment by the first assessing authority," establishing a clear and absolute deadline.
  • 2. Rule 12(7), which provides a three-month submission period and allows extensions for Forms 'C' and 'F', does not mention Form 'H' and thus does not apply.
  • 3. Rule 12(10)(b) refers to the mutatis mutandis application of certain procedural provisions concerning authority, custody, and use of Form 'H' similar to Form 'C', but crucially does not import the time extension provisions.
  • 4. The State Government of Andhra Pradesh had not enacted any rules under Section 13(3) of the CST Act that would alter the prescribed time for Form 'H'.
  • 5. Since Form 'H' is a statutory condition precedent for exemption under export sales, it cannot be accepted after assessment completion.

The Bench further analyzed earlier Division Bench decisions which had extended the benefit of Rule 12(7) to Form 'H' but concluded that those orders did not correctly interpret the statutory scheme. The court emphasized the need for strict interpretation of taxation statutes, citing Supreme Court precedents that tax exemptions and timelines must be adhered to rigidly to prevent unintended extensions.

Conclusion and Impact:

The Full Bench held that the time limit for submission of Form 'H' is strictly up to the completion of the first assessment, and the extension provisions applicable to Forms 'C' and 'F' under Rule 12(7) do not extend to Form 'H'. This decision mandates that exporters and dealers ensure timely submission of Form 'H' within the assessment window to avail the export sales exemption under the CST Act.

This ruling settles conflicting judicial precedents and provides clarity to tax authorities and taxpayers regarding procedural compliance. It is expected to impact numerous pending and future assessments involving export sales and CST exemptions in Andhra Pradesh.

The court disposed of all the related writ petitions accordingly, without any orders as to costs.

Bottom Line:

Central Sales Tax - Form 'H' for claiming exemption on penultimate export sales under Section 5(3) read with Section 5(4) of the CST Act must be furnished up to the time of assessment by the first assessing authority - Time limit and extension provision applicable to Forms 'C' and 'F' under Rule 12(7) of the CST (Registration and Turnover) Rules, 1957 do not apply to Form 'H' - Rule 12(10)(b) does not import parity regarding time limit.
