Court Allows Amendment to Resolve Real Controversies Without Altering Suit's Nature
In a significant ruling, the Andhra Pradesh High Court has allowed amendments to pleadings even after the commencement of the trial, emphasizing the need to resolve real controversies without causing injustice to the other party. The judgment, delivered by Justice Ravi Cheemalapati, came in response to a civil revision petition filed by Sidagam Jatlamma, the petitioner, against the order of the trial court which had earlier dismissed her application for amendment.
The petitioner had originally filed a suit for partition of family properties and sought to amend the name in the cause title and correct a typographical error in the property description, changing the extent from 1100 sq. yards to 0.03 acres. The trial court had dismissed this application, citing negligence and the potential for altering the nature of the suit after the evidence stage. However, the High Court observed that boundaries prevail over extents in property description and that such amendments would not alter the nature of the suit, which was for partition.
Citing the precedent set in "Pirgonda Hongonda Patil v. Kalgonda Shidgonda Patil," the High Court reiterated that amendments should be allowed if they do not cause injustice and are necessary for determining the real questions in controversy. The court also noted that the requirement of due diligence is essential for post-trial amendments, but in this case, the amendments were deemed necessary to explain the material on record.
Consequently, the High Court set aside the trial court's order, allowing the amendments and reinforcing the principle that amendments should facilitate the resolution of real controversies without prejudicing the other side.
