Court Finds No Prima Facie Evidence Against Accused No. 5, Labels Continuation of Proceedings as Abuse of Process


In a significant ruling, the Andhra Pradesh High Court has quashed the proceedings against Guduru Uma Maheswara Rao, who was accused in a case involving the misappropriation of funds at Hotel Sindhuri in Guntur. The court found no prima facie evidence against Rao, who was listed as Accused No. 5, and deemed the continuation of proceedings against him as an abuse of the legal process.


The case revolved around allegations that several employees at Hotel Sindhuri, including the General Manager and other senior staff, colluded to misappropriate funds amounting to Rs. 50,93,792. They were accused of preparing duplicate receipts, collecting money from customers, and failing to deposit the same into the hotel's account, thereby causing a substantial financial loss to the hotel's managing director, who filed the complaint.


Justice K. Sreenivasa Reddy, presiding over the case, noted that the petitioner, Rao, was employed merely as a Boy at the hotel and was not involved in the financial operations or the alleged misappropriation activities. The court emphasized that the allegations and evidence were primarily directed at other accused individuals (Accused Nos. 1 to 4) and that the accusations against Rao were vague and unsubstantiated.


The judgment drew upon the principles set forth in the landmark Supreme Court case State of Haryana v. Ch. Bhajanlal, which delineates scenarios where criminal proceedings may be quashed to prevent misuse of the judicial process. The court highlighted that the allegations against Rao did not constitute a cognizable offense and lacked the necessary ingredients to proceed with the prosecution under Sections 408 (Criminal breach of trust by clerk or servant) and 120B (criminal conspiracy) of the Indian Penal Code.


Justice Reddy concluded that forcing the petitioner to undergo trial without any substantial evidence would be unjust, thereby ordering the quashing of proceedings against Rao. The court's decision underscores the judiciary's role in safeguarding individuals from unwarranted legal actions and ensuring that the legal process is not abused.


The ruling has brought relief to Guduru Uma Maheswara Rao, as he is now free from the legal entanglements that have overshadowed his life since the allegations were made.
